C.M.P. No.5361 of 2016 in CRP NPD. No. 1336 of 2009 D. KRISHNAKUMAR J., This Miscellaneous Petition has been filed seeking for stay of all further proceedings in REP No. 42 of 2012 pending in O.S. No.146 of 2012 on the file of the I Additional District Munsif Court, Salem, pending C.R.P. No. 1336 of 2009.

2. Learned counsel for the petitioner submitted that out of the decree amount ordered by the First Additional District Munsif, Salem, in the R.E.P.No. 42 of 2012, the petitioner undertakes to deposit Rs.28,000/-, with accrued interest, within a period of four weeks from today.

3. In view of the undertaking given by the revision petitioner, there shall be an order of interim stay of all further proceedings in REP No. 42 of 2012 pending in O.S. No.146 of 2012 on the file of the I Additional District Munsif Court, Salem, pending C.R.P. No. 1336 of 2009. In the event of failure, the interim stay granted shall stand vacated without any reference to this Court.

4. Learned counsel for the respondent accepted to the said proposal made by the Revision petitioner. On making such deposit, the respondent creditor is permitted to withdraw the aforesaid deposited amount, on submission of due application.
