ORDER

The petitioner, who was arrested and remanded to judicial custody on 09.03.2025, for the offence punishable under Sections 3(b) read with Section 4 of POCSO Act in connection with Crime No.5 of 2025, registered on the file of the respondent, seeks bail.

2. The case of the prosecution is that the petitioner committed a heinous offence by sexually harassing a minor victim who was merely three years old. Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. He further submitted that the petitioner is under custody from 09.03.2025, and prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl. Side) appearing for the respondent police vehemently opposes the petitioner's bail application. The Government Advocate further submits that the offense alleged is serious and heinous, and the victim is a vulnerable child aged three years. The Government Advocate contends that releasing the petitioner on bail would pose a significant risk to the safety and well being of the victim and may also interfere with the investigation or tamper with the evidence. Hence, opposed for grant of bail to the petitioner.

5. Heard both sides and perused the records.

6. The allegations against the petitioner are grave and serious, involving the sexual assault of a three year old child. The tender age of the victim and the nature of offense alleged raise significant concerns about the safety and well-being of the victim. After carefully considering the submissions made by both sides, this Court find that granting of bail to the petitioner at this stage would not be in the interest of justice, hence, this Court is not inclined to grant the relief sought for by the petitioner.

7. Accordingly, this Criminal Original Petition stands dismissed. 18-06-2025 Jai
