Prayer: Writ petition filed under Article 226 of the Constitution of India, praying for the issuance of Writ of Mandamus, directing the respondents 1 and 2 to consider the petitioner's representation dated 15.09.2020, regarding cancellation of the settlement deed dated 21.06.2019 and Exchange deed dated 08.06.2020 and initiate steps within a time frame thereon.

This Writ Petition has been filed for the issue of a Writ of Mandamus directing the respondents 1and 2 to consider the representation made by petitioner on 15.09.2020 wherein the https://hcservices.ecourts.gov.in/hcservices/

petitioner is seeking for cancellation of the settlement deed dated 21.06.2019 and the exchange deed dated 08.06.2020.

2. Heard Mr.G.Punniakoti, the learned counsel appearing on behalf of the petitioner and Mr.T.M.Pappiah, learned Special Government Pleader appearing on behalf of the respondents 1 and 2.

3. In the considered view of this Court, the first and second respondents do not have any power to cancel any registered documents. If the petitioner is aggrieved by the execution of the settlement deed and exchange deed, the petitioner will have to necessarily approach the competent Civil Court and question the same and seek for an appropriate declaration. The first and second respondents do not have the power to cancel any documents and the law on this issue is well settled.

4. In view of the above, this Court does not find any ground to entertain this Writ Petition and accordingly, the same is dismissed. No costs.
