ORDER

The petitioner, who was arrested and remanded to judicial custody on 15.04.2026 for the offences punishable under Sections 138, 143(1)(d), 316, 318 of BNS, 2023 and Sections 10 and 24 of Emigration Act, 1983 and Section 66D of IT (Amendment) Act, 2008, in Crime No.50 of 2026, on the file of the respondent, seeks bail.

2. The learned counsel for the petitioner, pleading innocence on the part of the petitioner, who has been in incarceration since 15.04.2026 and false implication in the case, seeks indulgence of this Court. He further submits that

the petitioner name is not mentioned in the FIR and the petitioner has no previous case. He also submits that the petitioner is ready to abide by any stringent condition that may be imposed by this court.

The case of the prosecution, as put forth by the learned Government Advocate (Criminal Side) appearing for the respondent police, opposing for grant of bail, is that the petitioner and other accused induced gullible public to apply for online job and after receiving money, trafficked them for committing online scam at Vietnam and Cambodia and thus, cheated the defacto complainant and others. He further submits that the petitioner has no previous case and co-accused was released on bail by this Court. However, opposed the bail.

4. Heard both sides and perused the materials on record.

5. Considering the rival submissions on either side, nature of offence and the fact that co-accused was already released on bail, no previous cases are pending against the petitioner and considering the incarceration period spent by the petitioner from 15.04.2026, I am inclined to grant bail to the petitioner, subject to the following conditions:

[a] Accordingly, the petitioner is ordered to be released on bail on condition to execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned XI

Metropolitan Magistrate Court, Saidapet, Chennai and on further conditions that:

[b] the petitioner shall report before the respondent police daily at 10.00 a.m., until further orders.

[c] the petitioner shall not commit any offence similar to the offence of which he is accused, or suspected, or of the commission of which he is suspected;

[d] the petitioner shall not abscond either during investigation or trial; [e] the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence;

[f] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
