Respondents Writ Petition filed under Article 226 of the Constitution of India praying for a issuance of Writ of Mandamus directing the respondent to complete the proceedings initiated in terms of the Tamilnadu Agricultural Land Record of Tenancy Rights act (Act 10 of 1996) pursuant to the notice issued in Na.Ka.A2/11614/13 dated 11.12.2013 after affording opportunity to all the parties. For Petitioner : Mr.S.Kamadevan For Respondent : Mr.D.Suriya Narayanan Government Advocate O R D E R Heard Mr.S.Kamadevan, learned counsel appearing for the petitioner and Mr.D.Suriya Narayanan, learned Government Advocate appearing for respondent and perused the materials placed on record. With the consent on either side, the Writ Petition itself is taken up for final disposal at the admission stage.
2.The petitioner has filed this Writ Petition for a direction to the respondent to complete the proceedings initiated under the provisions of the Tamilnadu Agricultural Land Record of Tenancy Rights Act (Act 10 of 1996).
3.According to the petitioner, based on the application given by him, the respondent has commenced enquiry and issued notice dated 11.12.2013 fixing the date of enquiry as 25.12.2013 by directing the https://hcservices.ecourts.gov.in/hcservices/
petitioner as well as Tmt.Maragambal, daughter of Rajampillai, Jayaraman, son of Rajampillai, Selvaraj son of Rajampillai and Kumar son of Rajampillai to appear for enquiry. It is submitted that though enquiry was said to be conducted on the said date, subsequently, it was adjourned and thereafter, no fresh date for enquiry is fixed nor final orders are passed.
4. In the light of the above, there will be a direction to the respondent to issue a fresh notice to the petitioner as well as the legal heirs of Rajampillai, fix a fresh date of personal hearing and after hearing the parties, pass appropriate orders on merits and in accordance with law within a period of three months from the date of receipt of copy of this order.
With the above observation, this Writ Petition is disposed of. No costs.
