L.Chandran ... Respondent

Prayer in C.M.P.No.12788 of 2022: Civil Miscellaneous Petition filed under Section 5 of the Limitation Act to condone the delay of 50 days in filing the above Review Application against the order in W.A.No.2072 of 2021 dated 06.10.2021.

Prayer in Rev.Appl.SR.No.76004 of 2022 : Review Application filed under Order 47 Rule 1 r/w. Section 114 of Code of Civil Procedure against the order dated 06.10.2021 made in W.A.No.2072 of 2021. For Petitioners :

Mr.Venkatesh Prasad for M/s.T.S.Gopalan and Co.

in all cases For Respondent :

Mr.S.N.Ravichandran in all cases C O M M O N O R D E R (Order of the Court was made by S.S. SUNDAR, J.) These petitions are filed to condone the delay of 50 days in filing the above Review Applications.

2.After service of notice, Mr.S.N.Ravichandran, learned counsel who is appearing for the respondent in all cases, submitted that the delay itself is wrongly calculated. However, the Registry has accepted the explanation. The explanation offered by the petitioner is convincing. Excluding the period of limitation which was extended by the order of the Hon'ble Supreme Court, this Court accepts that the delay is only 50 days in filing the above Review Applications. Assuming for a moment that the delay was calculated wrongly as contended by the learned counsel for the respondent, this Court is not inclined to take it as a serious issue doubting the bona fides of the petitioner, since this Court is fully convinced with the reasons stated in the affidavit filed in support of the petitions, especially when the petitioner has given sufficient cause for the delay to the satisfaction of this Court. Therefore, the delay is condoned and these petitions are ordered. (S.S.S.R., J.) (A.A.N., J.) 29.10.2024 mkn Internet : Yes S.S. SUNDAR , J.
