The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Section 11(i) r/w 12 of Protection of Children from Sexual Offences Act, 2012 Crime No.15 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner is alleged to have shown obscene gesture and caused sexual harassment on the victim girl, who is aged about 17 years. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit the petitioner and the victim girl are relatives and had developed love affair. Due to which, there arose a dispute between the petitioner's family and the victim girl's family. Therefore, a false case has been foisted against the petitioner and he has not committed any offence as alleged by the prosecution and he is no way connected with the alleged offence. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor had produced the statement recorded under Section 164 Cr.P.C. A perusal of the statement reveals that the petitioner fell in love with the victim girl. On the pretext of love affair, he had taken out the victim girl and had taken nude photographs of her. Thereafter, he threatened the victim girl to live with him, otherwise if she discloses the same, he would upload her photos in the social media. On so many occasions, the petitioner had continuously given sexual torture to the victim girl. Therefore, the victim girl even could not write her examinations. Hence, he vehemently opposed to grant of anticipatory bail to the petitioner.

5. Taking into consideration the above facts and circumstances of the case, since the petitioner has committed very serious and heinous offence as against the victim girl, this Court is not inclined to grant anticipatory bail to the petitioner.
