Petitioners v.

Mrs.P.Sri Venkata Priya, I.A.S., Chairman, Teachers Recruitment Board 4th Floor, E.V.K.Sampath Maligai DPI Compound, College Road Chennai 600 006 ..

Respondent Petition filed under Section 11 of the Contempt of Courts Act, 1971 praying to punish the respondent for wilful disobedience of the order dated 27.02.2019 made in W.P.No.4633 of 2019.

For Petitioner ::

M/s.Kanimozhi Mathi For Respondent ::

Mr.R.Neelakandan Additional Advocate General assisted by Mr.C.Kathiravan Special Government Pleader

ORDER

The only grievance of the petitioners is that their names have been included in the waiting list published in the year 2019 for selection to the post of Physical Education Teacher (Special Teacher). Recruitment notification was issued in the year 2017. Selection list was published in the year 2019. This Court, by order dated 27.02.2019 in W.P.No.4633 of 2019, directed that the case of the petitioners is to be considered within the parameters and as per the conditions applicable to wait list/reserve list candidates.

2. The learned counsel for petitioners would submit that the wait list has not been released and therefore the petitioners are unable to secure selection.

3. Selection or appointment cannot be claimed as an absolute right. The life of the wait list/reserve list is one year under normal circumstances.

4. The learned Additional Advocate General appearing on behalf of the respondent would submit that the petitioners are not within the zone of

consideration and therefore their names are not considered.

5. Admittedly, the wait list has not been released for the purpose of appointing the selected candidates. Therefore, the petitioners cannot claim appointment as a matter of right and therefore the present contempt petition deserves no further adjudication. Accordingly, the contempt petition stands closed.
