Crl.O.P.No.15161 of 2024 T.V.THAMILSELVI, J.

The petitioners, who were arrested and remanded to judicial custody on 10.06.2024 in Crime No.143 of 2024, for the offences punishable under Section 304(2) of IPC, seeks bail.

2. Learned counsel appearing for the petitioners submitted that the petitioners are innocent persons, and it was merely an accident happened in the company, the deceased were died due to sudden emanation of poisonous gas, even though safety equipments were provided to him, due to their negligence, the accident had happened, for which, the defacto complainant, who is the wife of one of the deceased person has given a false complaint against the petitioner. He further submitted that the deceased family was given compensation of Rs.5 lakhs to each family. He further submitted that the petitioners are suffering incarceration from 10.06.2024 and they are ready to abide any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent police raised objection for granting bail to the petitioners stating that the petitioners are the supervisors and security in Senthamarai Engineering Company. On 08.04.2024, when the deceased persons were doing cleaning work in the benzene Tank in the said company and without any safety equipments, they were attacked by poisonous gas. Later they were taken to the hospital and two of them died. As a result, the defacto complainant, lodged a complaint against the petitioners. He further submitted that the investigation is still pending. Hence, he prayed for dismissal of the bail petition.

4. Taking into consideration the facts and circumstances of the case and the submission made by the learned counsel on either side and also considering the grave nature of offence, and the investigation is at initial stage, this Court is not inclined to grant bail to the petitioners.

5. Accordingly, this Criminal Original Petition stands dismissed.
