O R D E R

This writ petition has been filed to direct the first respondent to forthwith issue family pension to the petitioner.

2. The facts in brief are as follows:- Late S.Karuppasamy, husband of the petitioner was appointed as an Emergency Assistant Engineer Electrical in the Tamil Nadu Electricity Board, vide appointment letter, dated 19/7/1979 and retired as Assistant Electrical Engineer/Carrier Communication Lab in 2005 and ever since, he has been receiving pension. The deceased succumbed to COVID on 8/5/2021, leaving behind the petitioner and two children as his legal heirs.

3. After the demise of the deceased, being the spouse, petitioner is not receiving family pension and other emoluments. Hence sent representations Page No:2/6

dated 23/9/2021, 18/5/2022 to the first respondent. Vide, letter dated 14/6/2022, first respondent had stated that names of the petitioner and two children were not nominated for family pension. Having no othe option, the petitioner had approached this Court praying for the relief as stated therein.

4. Heard Ms.Priyadharshini, learned counsel for the petitioner and Mr.K.Rajkumar, learned Standing Counsel for the respondents.

5. The learned counsel appearing for the petitioner submits that it would be suffice if this Court issues direction to the first respondent to consider the petitioner's representations dated 23/9/2021, 18/5/2022 and pass orders on the same, within a particular time frame fixed by this Court.

6. The learned Standing Counsel appearing for the respondents has no objection for the said order being passed and he fairly conceded that the petitioner's representations dated 23/9/2021, 18/5/2022 will be considered and appropriate orders will be passed within the time stipulated by this Court.

7. In view of the aforesaid submissions, this Court without expressing any opinion on the merits of the case, directs the first respondent to consider the petitioner's representations dated 23/9/2021, 18/5/2022 on merits and in accordance with law and pass appropriate orders, within a period of four weeks from the date of receipt of a copy of this order, after seeking any clarification, if any required from the petitioner.

8. This writ petition is accordingly disposed of. No costs. 6/1/2025 mvs.
