Prayer : Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus forbearing the 1st and 2nd Respondents from in any manner demolishing or disturbing the petitioner's leased premises at First Floor, Door No.513A, above Dhandapani Jewellery, Trichy Road, Singanallur, Coimbatore 641 005 without following due process of law by issuance of appropriate show cause notice and granting opportunity to the petitioner. ORDER

(Made by G.R. SWAMINATHAN, J.) Heard learned counsel for the petitioner and learned Standing Counsel for the Coimbatore City Corporation.

2. The petitioner is a tenant in occupation of the petition mentioned premises. It appears that the premises has not been approved and is facing a threat of demolition at the hands of the Corporation.

3. The petitioner is not able to produce any definite material to show that the building in question has been duly approved. Learned counsel for the petitioner states that the petitioner will vacate the premises within five months from today. Learned counsel also undertakes to file an affidavit to that effect before respondent No.1.

4. The petitioner shall file such an affidavit within two weeks from today. If the affidavit is filed within the stipulated time, respondent Nos.1 and 2 shall not to take any coercive action against the petition mentioned premises for a period of five months from today. If the affidavit is not filed within the time, the Corporation is at liberty to proceed in the manner known to law.

5. The writ petition is disposed of accordingly. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
