ORDER
The petitioner, who was arrested and remanded to judicial custody on 15.02.2023, for the offence punishable under Sections 120(B), 449, 149, 196 r/w 404 of IPC in connection with Crime No.404 of 2013 on the file of the respondent, seeks bail.
2. The case of the prosecution is that the petitioner along with other Page No.1 of 4
accused killed a victim named Lakshmi. For his non-appearance before the trial court, NBW was issued against him on 21.08.2019 and executed on 15.02.2023.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. The petitioner is inside the prison for more than two years. He further submitted that the petitioner has appeared regularly before the trial court and the case was posted on 21.08.2019 for further proceedings on which he was unable to attend the court. He further submitted that investigation has been completed and now the case is posted to 23.06.2025 for examination of the accused under Section 313 Cr.P.C., He further submitted that earlier bail application filed by the petitioner in Crl.MP.No. 3389 of 2024 before the trial court was dismissed on 20.12.2024. He seeks to complete the trial without any further delay and detention of the petitioner at this stage is not required. The petitioner is ready to abide by any condition imposed by this court. Hence, he prays for grant of bail.
4.The learned Government Advocate (Crl. Side) appearing for the respondent police submitted that totally there are five accused and A5 had already died and this is a jumped bail. For non-appearance of the petitioner, Page No.2 of 4
NBW was issued against him by the trial court on 21.08.2019 and he was arrested on 15.02.2023. There are 6 previous cases pending against the petitioner. Investigation Officer examined on 09.04.2025 and now the case is posted to 23.06.2025 for questioning the petitioner. Hence, custodial interrogation of the petitioner is required in this case. If the petitioner is let out on bail, the investigation will be affected.
5. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) for the respondent Police and perused the materials available on record.
6. Considering the submission made by the learned counsel appearing on either side and grave nature of offence, this Court is not inclined to grant bail to the petitioner at this stage.
7.The Trial Court is directed to conclude the trial within a month and pronounce Judgment on or before 30.07.2025.
