The petitioner namely Arun, who apprehends arrest at the hands of the respondent police for the alleged offences under Sections 379 of IPC and Section 21(1) of Mines and Minerals (Development & Regulation) Act, 1957 in Crime No.254 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. Learned counsel for the petitioner submitted that, petitioner got valid permit to transport the river sand. In support of his submission, he produced a copy of the permit. Petitioner is innocnet. Apprehending arrest, this petition is filed.

3. In response, learned Government Advocate (Crl. Side) submitted that, petitioner had illegally transported 1 unit of river sand on 16.05.2023 in a vehicle bearing Nos.TN 457 AE 4188 and TN 47 B 8172. He further submitted that, the permit shown by the petitioner relates to 13.05.2023 and this has no relevance to the illegal sand taken on 16.05.2023. 4. Considering the fact that, petitioner had illegally transported river sand, without any valid permit and that investigation in this case is pending, this Court is not inclined to grant anticipatory bail to the petitioner. Thus, this Criminal Original Petition is dismissed.
