The petitioner who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 394 of IPC, in Crime No.373 of 2021, seeks anticipatory bail.

2. The case of the prosecution is that when the defacto complainant and his family members were sleeping at their home, the petitioner and other accused knocked their door requesting for drinking water stating that an accident had occurred. Thereafter, the accused persons threatened the defacto complainant and tried to enter into their home to commit robbery. On hearing the barking of dogs, the accused persons ran away from the scene of occurrence. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and no way connected with the alleged offence and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that the petitioner herein is having three previous cases. He would further submit that there is no change of circumstances after the previous dismissal order passed by this Court. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the facts and circumstances of the case and the bad antecedent of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 26.07.2022 mn
