Respondents PRAYER : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the 1st Respondent to withdraw the case in Crime Number 118 of 2023 pending on the file of the 3rd Respondent and entrust the same to the 4th Respondent for fair investigation and to file the final report within a time frame fixed.

This petition has been filed seeking for transfer of investigation in Crime No.118 of 2023 pending on the file of the 3rd respondent to the file of the 4th respondent.

The learned Additional Public prosecutor on instructions submitted that investigation has been completed and a closure report is going to be filed as mistake of fact before the Principal Sessions Court, Salem and RCS notice has also been served on the defacto complainant in RCS No.29 of 2023.

In view of the above development, it is left open to the petitioner to work out his remedy before the concerned Court by filing a protest petition and the concerned Court shall consider the same and pass appropriate order in accordance with law.
