.. Respondents PRAYER: Writ petition is filed under Article 226 of Constitution of India, pleased to issue a Writ of Mandamus, directing the respondents 1 to 3 herein to grant the pay band of Rs. 37,400 -67,000 + Grade Pay of Rs. 9000 with 1/4

effect from 02/12/2009 to the petitioner and pay all arrears with interest at the rate of 12% per annum from the dates on which the amounts became due till date of disbursement.

ORDER

In the light of the letter that has now been received from the Member Secretary cum Director, Higher and Technical Education stating that the proposal for grant of upward AGP movement from Grade Pay Rs.8000Rs.9000 (Stage III to Stage IV) under Career Advancement Scheme (CAS) payable to the petitioner is already been approved by all other authorities and the file is now pending before the Under Secretary to Government (Higher and Technical Education), Puducherry and the said grade pay would be paid at the earliest. The grievance of the petitioner appears to have been redressed. 2/4

Taking note of the above statement, this writ petition is disposed of directing the 1st respondent to consider the approval and pass orders granting upward AGP movement from Grade Pay Rs.8000-Rs.9000 to the petitioner within a period of four weeks from the date of receipt of a copy of this order.

3. At this juncture, the learned counsel for the petitioner would submit that the amount payable as early as in the year 2009 was not paid and the petitioner is entitled to get interest and the same may also be considered. No costs.
