..Respondent This civil suit coming on this day before this court for hearing the court made the following order:- When the matter came up for hearing, on perusal of the pleadings and other materials on record, the following issues are framed for consideration:

1. Whether the use of the mark 'Uncompromise' by the defendant constitutes passing off of the plaintiff's mark 'Akshya Uncompromise'?

2.

Whether the use of the mark 'Uncompromise' by the defendant amounts to infringement of the plaintiff's mark 'Akshya Uncompromise'?

3. To what other reliefs are the parties entitled to?

Post the suit before the Additional Master - I for recording evidence on 16.10.2019. The plaintiff side evidence shall commence from 16.10.2019 and the cross examination shall be completed before 25.10.2019. The defendant side evidence shall commence from 30.10.2011 and the defendant's side evidence shall be completed before 08.11.2019.

Post before this Court on 15.11.2019 for filing written arguments.
