ORDER

This criminal original petition has been filed seeking a direction to the respondent police to file a charge sheet on the basis of the FIR No.38 of 2016 dated 06.04.2016 and to take appropriate action.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3. It is seen that on a complaint given by the petitioner, the respondent police registered a case in Crime No.38 of 2016 on 06.04.2016 under Section 380 IPC against Simion. It is alleged in the complaint that the petitioner was in Saudi Arabia and that on 25.02.2016, when his wife and others were away from their house, someone had entered the house and taken away some jewellery and cash and that they suspect involvement of Simon, who is the brother-in-law of the petitioner. Under such circumstances, the petitioner has come before this Court with a direction to complete the investigation and file a final report expeditiously.

4. Further, it is seen that this petitioner only suspects the involvement of Simion. That apart, for the incident that https://hcservices.ecourts.gov.in/hcservices/

had taken place from 15.02.2016 to 27.02.2016, a complaint was given only on 06.04.2016.

5. The learned Additional Public Prosecutor submitted that there are lot of disputes between the petitioner's family and Simion and therefore, the police suspect the genuineness of the complaint.

6. Under such circumstances, the respondent police is directed to expeditiously conduct enquiry and either close the FIR or take action in accordance with law.

With the above direction, the criminal original petition is closed.
