O R D E R
(Order of the Court was made by The Hon'ble Chief Justice) The petitioner, a journalist and editor of Indian Reporter ''Magazine'' and also the President of ''Indian Makkal Mandram'', based on reports in the newspapers on certain incidents relating to the law and order, seeks to file the present petition with the following prayers:
(1)To direct the 1st and 2nd respondents immediately making transfer of Mr.T.K.Rajendran, I.P.S., Commissioner of Police, Chennai and Mr.V.Varadharajulu, I.P.S., Additional Commissioner of Police (Intelligent Wing Chennai). (2)To direct the 1st to 3rd respondents to make immediate, necessary and special arrangement to provide police protection to the people of the Greater Chennai contemplated under Section 17 of the Chennai City Police Act, 1888.
2.The body of the petition or the documents filed with it other than newspaper reports and the representation contain nothing. That law and order has to be maintained is obvious. That seeking mandamus from the Court that law and order should be maintained is, thus, of a little purpose.
3.We may also notice that already suo motu proceedings in W.P.No.22303 of 2016 have been taken with specific question raised as to how preventive measures can be tightened and we have called upon the comments of the State Government in that behalf.
4.The second prayer is seeking transfer of police officers. As to which police officer should hold which post is prerogative of the State Government.
5.We, thus, do not find any purpose in maintaining this public interest litigation.
6.Writ petition is dismissed. No costs. Consequently, W.M.P.No.19567 of 2016 is also dismissed.
