This Criminal Original Petition has been filed by the petitioner/A1, who was arrested and remanded to judicial custody on 14.06.2024, seeking bail in Crime No.229 of 2024 registered for the offence under Section 328 of IPC r/w Section 7 of Cigarettes and other Tobacco Products Act, 2003.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is no way connected with the alleged offence and he travelled in the alleged vehicle by asking lift and he was not aware of the contents in the vehicle and he has been suffering incarceration from 14.06.2024 and he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed to grant bail to the petitioner.

3. Learned Government Advocate (Criminal Side) appearing for the respondent police objected for granting bail stating that the petitioner/A1, who hails from the State of Karnataka, along with A2 had illegally transported 759 kilograms of banned tobacco products in their vehicle. He further submitted that the case is under investigation, therefore, if he is released on bail, there is every possibility of him absconding and not available for further investigation. https://www.mhc.tn.gov.in/judis

4. Taking into consideration the facts and the submissions made by the learned Government Advocate (Crl.Side) that the investigation is at initial stage and considering the quantity of banned tobacco products transported by the accused, this Court is not inclined to grant bail to the petitioner.
