Petition filed under Article 226 of the Constitution of India for the issuance of writ of Mandamus, directing the Respondents to considerr and pass orders on petitioner's representation dated 24.09.2013 regarding payment of 25% of the service benefits of late T.A.Sampathraj, Tax Collector, Zone V, Corporation of Chennai to the petitioner.

O R D E R

The petitioner is the widow of Thiru.T.A.Sampathraj, who worked as Bill Collector in Chennai Corporation. Thiru.Sampathraj retired from service on 30.11.2006 on attaining the age of superannuation. Subsequently, he died on 26.07.2012. It is the grievance of the petitioner that she was not paid 25% of service benefits due to Thiru.Sampathraj. The petitioner submitted a representation on 24.09.2013 requesting the first respondent to pay her part of the DCRG benefits retained by the Corporation. Since follow up action was not taken by the respondents, the petitioner is before this Court.

2. The learned Standing Counsel for the Chennai Corporation on instructions submitted that 25% of DCRG benefits was withheld by the Corporation on account of audit objection.

3. The first respondent is directed to consider and dispose of the representation submitted by the petitioner dated 24.09.2013 on merits and as per law. Such exercise shall be carried out within a period of two months from the date of receipt of a copy of this order.
