D.Abirami, v. Anna University Of Technology,
IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED : 27.03.2015
CORAM
THE HONOURABLE MR.JUSTICE T.S.SIVAGNANAM WP.No.8835/2015 D.Abirami ..
Petitioner
Versus
1.The Registrar Anna University of Technology, Tiruchirappalli & District.
2.The Head Mistress St. Joseph's Higher Secondary School Mannargudi & Taluk, Thiruvarur District.
.. Respondents Writ petition filed under Article 226 of the Constitution of India praying for a writ of mandamus to direct the 2nd respondent to issue Fresh Transfer Certificate [TC] after making due correction of the petitioner's father name as Deenadayalan instead of Deenadhayalan and consequently to direct the 1st respondent to issue fresh Transfer Certificate with correct spelling of petitioner's father name as mentioned above after receiving altered new Transfer Certificate from the 2nd respondent.
For Petitioner :
Mr.P.Vijendran For R1 :
Mr.M.Vijayakumar, Standing Counsel
ORDER
Heard Mr.P.Vijendran, learned counsel appearing for the petitioners and Mr.M.Vijayakumar, learned Standing Counsel accepting notice for the 1st respondent and with their consent, the writ petition itself is disposed of at the admission stage itself. 2.In the light of the orders to be passed by this Court, notice to the 2nd respondent is dispensed with. 3.The petitioner has filed this writ petition seeking for the relief of directing the respondents to issue fresh Transfer
Certificate mentioning the name of the petitioner's father with the correct spelling.
4.It is seen that the petitioner completed her 12th standard from the 2nd respondent School and a Transfer Certificate was issued on 14.05.2009, mentioning the petitioner's father name as "B.DEENADHAYALAN" . The correct spelling of the petitioner's father name is "B.DEENADAYALAN". This is supported by the documents relating to the petitioner's father, viz., the Pension papers as well as the Ex-serviceman Identity Card. Based on these records, the School authorities were satisfied and they effected proper correction in the petitioner's 12th Standard Certificate. Thereafter, the petitioner joined the 1st respondent/University and completed her Engineering Course. After completing the course, she wants the Transfer Certificate from the University mentioning the correct name of her father as "B.DEENADAYALAN". 5.
In the light of the fact that already the 2nd respondent/School has effected corrections, there is no necessity for the School Authorities to give fresh Transfer Certificate and the authorities can take note of the correction effected in the Transfer Certificate issued by the 2nd respondent/School and attested by the Headmistress of the school concerned. However, insofar as the 1st respondent/University is concerned, they are bound to issue the Transfer Certificate with the correct name of the petitioner's father's name.
6.Accordingly, there will be a direction to the 1st respondent/University to take into consideration the correction effected in the petitioner's 12th standard Transfer Certificate and issue the Transfer Certificate to the petitioner mentioning the name of her father as "B.DEENADAYALAN", within a period of three weeks from the date of receipt of a copy of this order. 7.The writ petition is disposed of with the above direction. No costs.
