Petition filed under Article 226 of the Constitution of India for the issuance of writ of Mandamus, directing the Respondents to count the period of service rendered by the Petitioner between 23.01.1962 to 21.03.1962 , 16.04.1962 to 14.07.1962 of Military Service and 09.02.1963 to 31.07.1963 and training period from 01.02.1965 for the purpose of Pensionary benefits as per the recommendation of Executive Officer Government ITI Chengalpattu dated 28.06.2007 and that of the representation dated 13.07.2009. O R D E R

The petitioner was in military service for the period from 23.01.1962 to 21.03.1962 and from 14.02.1962 to 14.07.1962. Th petitioner was thereafter appointed as Instructor for Motor Mechanic trade on 09.02.1963 in Katpadi Township. He was terminated from service on 31.07.1963. The petitioner was re-appointed as Junior Instructor on 13.09.1963. His services were regularised on 13.02.1967. The petitioner on attaining the age of superannuation retired from service. The earlier service of the petitioner was not taken note of for the purpose of computing statutory benefits. The petitioner submitted a representation on 13.07.2009 requesting the first respondent to count the earlier service. The representation is stated to be pending on the file of the first respondent. https://hcservices.ecourts.gov.in/hcservices/

2. The first respondent is directed to consider and dispose of the representation submitted by the petitioner dated 13.07.2009 on merits and as per law. Such exercise shall be carried out within a period of four months from the date of receipt of a copy of this order.

3. The petitioner is directed to forward a copy of the representation along with a copy of this order so as enable the first respondent to dispose of the matter as expeditiously as possible.

4. The writ petition is disposed of with the above direction. No costs.
