The petitioner, who was arrested and remanded to judicial custody on 10.03.2022 at the hands of the respondent police for the offences punishable under Sections 8(c) r/w 22(C), 29(i) of NDPS Act, 1985, @ 8(c), 20(b)(ii)B, 22(a), 22(c) of NDPS Act, 1985, in Crime No.155 of 2022, seeks bail.

2. Heard both sides.

3. The case of the prosecution is that the petitioner was in possession of 390 grams of Methampetamine illegally. Hence, the complaint.

4. The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in this case and he is ready and willing to abide by any stringent condition that may be imposed on him. He would further submit that only based on the confession statement of the co-accused, the petitioner has been implicated as an accused. He would also submit that the petitioner was taken to illegal custody for 5 days. Hence, he prays for grant of bail to the petitioner. https://www.mhc.tn.gov.in/judis

5. The learned Additional Public Prosecutor submitted that there are totally 10 accused in which the petitioner is arrayed as A9. The petitioner was found in separate possession of 390 grams of Methampetamine illegally. Hence, he vehemently opposed to grant bail to the petitioner.

6. Taking into consideration the bad antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.
