In view of the fact that the rejection of Approval Petition filed by the Management has been confirmed by this Court in W.P.No.26281 of 2014 dated 29.07.2019, in the light of the judgment of the Supreme Court in Neethivalangan case reported in Tamil Nadu State Transport Corporation vs. Neethivilangan, Kumbakonam reported in (2001) 9 SCC 99, the respondent shall reinstate the worker with all benefits and the petitioner is supported by the order of Division Bench of this Court reported in Tata Iron And Steel Company Ltd. vs G. Ramakrishna Ayyar reported in 1950 LLJ 1043.
2. Therefore, the writ petition is allowed. The respondents
shall implement the order within a period of two months from the date of receipt of a copy of this orders. No costs.
