Heard Mr.G.M.Anantha Kumar, learned counsel for the petitioner and Mr.S.Gunasekaran, learned Government Advocate appearing for the respondent. With the consent of either side, Writ Petition itself is taken up for final disposal at the admission stage.
2. The petitioner seeks for issuance of a Writ of Mandamus to direct the the respondent to transfer the Patta in the name of the petitioner based on his representation dated 19.11.2014.
3. The petitioner claims for grant of patta pursuant to judgment and decree in O.S.No.71 of 2003 on the file of the Learned District Munsif, Denkanikottai dated 19.11.2004. In the affidavit filed in https://hcservices.ecourts.gov.in/hcservices/
support of this petition, the petitioner submitted that the Defendants in the suit namely 1) Venkatraman, S/o.Kondappa Chetty @ Kondappa, 2) Rajaram, S/o.Venkatraman & 3) Govindan, S/o.Venkatraman have not filed any appeal as against the decree and the same has become final. Mentioning these facts, the petitioner has filed an application before the respondent for grant of patta. Since the application has not been considered, the petitioner is before this Court.
4.In the light of the above facts, there will be a direction to the respondent to consider the petitioner's application / representation dated 19.11.2014, issue notice to the petitioner and after hearing the parties and satisfying himself that the decree has become final shall pass orders on merits and in accordance with law within a period of eight weeks from the date of receipt of copy of this order.
5.With the above direction, this Writ Petition is disposed of. No costs.
