Notice was issued to R4 - R8 through Court as well as privately. Subsequently, it has been contended that the notice has been served and the names and address of the said respondents are printed in the cause-list and there is no appearance today.
2. The Writ petition had originally come up for consideration on 13.07.2022 when, taking note of the absence of the learned counsel for the petitioner, the writ petition was dismissed.
3. In the affidavit filed in support of this miscellaneous petition, it had been stated that non-appearance on 13.07.2022 was neither willful nor wanton and that it would only be appropriate that the writ petition be heard on merits.
4. Since the petitioner has a right to canvass and the Court has to examine whether the grievance raised can be redressed, I would allow this petition and consequently, restore W.P.No.6769 of 2016 back to file.
