ORDER

This Criminal Original Petition has been filed by the petitioner on 11.05.2026 under Section 483 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, praying to grant bail.

2. The petitioner/Accused was arrested and remanded to judicial custody on 15.09.2025 for the alleged offences punishable under Sections 5(1), 5(m) r/w Section 6 of POCSO Act and Section 96 of BNS, 2023, in Crime No.56 of 2025 on the file of the respondent-police.

The case of the prosecution is that the petitioner/accused had a sexual intercourse with the victim. Hence, the present case was registered.

4. Mr.P.Thinesh, learned counsel for the petitioner submits that the petitioner is an innocent and has been falsely implicated in this case, solely on suspicion. He further submits that he has been suffering incarceration from 15.09.2025. He, however, submits that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. He therefore prays to grant bail to the petitioner.

5. Per contra, Mr.L.Baskaran, learned Government Advocate (Criminal Side) appearing for the respondent-police submits that the petitioner was aged about 50 years. He further submits that the charge sheet has been filed by the respondent police and the case has been taken on file in Spl.S.C.No.263 of 2025 before the Sessions Judge, Mahalir Neethimandram (Fast Track Mahila Court), Tiruppur. He submits that the trial has been already commenced and witness

P.W.1-3 were already examined and at this stage, if the bail is granted to the petitioner, he may threaten the witness. Hence, he vehemently opposes to enlarge the petitioner on bail. Accordingly, he prays to dismiss the Criminal Original Petition.

6. Heard on both sides. This Court has perused the records.

On perusal of the records, it is revealed that the investigation has been completed and charge sheet has been filed and taken on file as Spl.S.C.No.263 of 2025 before the trial Court and the trial process has been already commenced and witnesses were examined. At this stage, if bail is granted to the petitioner, he may threaten the witnesses and there is every possibility for absconding and thereby, cause delay in the trial process. Considering the facts and circumstances of the case and the stage of the trial, and considering the above reasons and the overt act alleged against the petitioner, this Court is not inclined to grant bail to the petitioner.

8. Accordingly, this Criminal Original Petition is dismissed. 20-05-2026 ssa
