This Criminal Original Petition has been filed by the petitioner/A1, who was arrested and remanded to judicial custody on 28.04.2024, seeking bail in Crime No.1 of 2023 registered for the offences punishable under Sections 457, 380 & 302 of IPC.

2. Learned counsel appearing for the petitioner submitted that this is the second application for bail filed by the petitioner before this court and this Court had dismissed the earlier bail application vide order dated 06.06.2024 in Crl.O.P.No.12972 of 2024. He further submitted that the petitioner, who is a Doctor by profession, was implicated in this case, as if he along with his wife has committed murder of his mother due to the property dispute. He also submitted that the petitioner has nothing to do with the alleged offence and he was arrested on 28.04.2024 only based on the suspicion. Hence, he prayed for grant of bail to the petitioner.

Learned Government Advocate (Criminal Side) appearing for the respondent police submitted that the petitioner/A1 along with his wife/A2 had committed murder of his mother due to the property dispute and held a drama stating that someone has murdered his mother and committed theft of 8 sovereigns of gold. The case was initially registered in the Manalmedu Police Station in Crime No.1254 of 2020 and later transferred to the respondent in Crime No.1 of 2023 and the petitioner was arrested only on 28.04.2024.

4. He further submitted that the earlier bail petition of the petitioner was dismissed only on 06.06.2024 and there is no change in circumstances and the investigation is still pending. Therefore, if he is released on bail at this stage, there is every possibility of him absconding and not available for further investigation. Hence, he prayed for dismissal of the petition.

5. Taking into consideration the facts and circumstances of this case and the submissions made by the learned Government Advocate (Criminal Side) that there is no change in circumstances and the investigation is not yet completed, this Court is not inclined to grant bail to the petitioner.
