ORDER
The petitioner apprehends arrest for the alleged offence under Sections 318(4) of BNS (420 of I.P.C) in Crime No.17 of 2025 on the file of the respondent police seeks anticipatory bail.

The case of the prosecution is that the defacto complainant, namely Bhaskaranand Pandey, was induced by an unknown person through Telegram to deposit money on the promise of receiving higher returns. Believing the representation, the defacto complainant deposited a sum of Rs.97,770/-. Thereafter, neither the promised returns nor the principal amount was returned. Hence, the complaint.

The learned counsel appearing for the petitioner would submit that the petitioner has been falsely implicated in Crime No.17 of 2025 registered at Baijnath Police Station, Bageshwar District, Uttarakhand. The learned counsel would further submit that the petitioner is a college student and is a regular player of online video games, through which he had accumulated reward points. Based on information received from the Uttarakhand Police through the jurisdictional police in Tamil Nadu, the petitioner came to know about the pendency of the FIR. It is further submitted that according to the prosecution itself, the amount involved is only Rs.97,770/-. The petitioner, being a college student requires sufficient time to make arrangements and engage a lawyer at
Uttarakhand and participate in the proceedings. Hence, he prayed for the grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and strongly opposed to grant anticipatory bail to the petitioner.
5. I have given anxious consideration to the submissions made by the learned counsel on either side.

Considering the nature of the allegations and the quantum of the amount involved in the case and the fact that the petitioner is a college student, this Court is of the opinion that the petitioner has made out a prima facie case for grant of relief. Hence, this Court is inclined to grant an interstate anticipatory bail for a period of four weeks, subject to certain conditions
7. Accordingly, interim interstate anticipatory bail is granted to the petitioner subject to the following conditions: (i) The petitioner shall surrender before the learned Judicial Magistrate No.1, Ponneri, within seven (7) days from the date of receipt of copy of this order.
(ii) On such surrender, the petitioner shall be enlarged on bail on condition that he shall execute a bond for Rs.20,000/- (Rupees Twenty Thousand only), with two sureties each for a like sum to the satisfaction of the said Magistrate; (iii) Within four weeks of such surrender before the above said Magistrate, the petitioner shall seeks appropriate relief before any of the jurisdictional Courts in the State of Uttarakhand.
The petition is ordered accordingly.
