ORDER

The petitioner, who was arrested and remanded to judicial custody on 01.01.2026 for the alleged offences under Sections 5(l), 5(n) and 6 of POCSO Act, 2012 and Section 351(2) of B.N.S. in Cr. No.1 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner, who is a paternal uncle of the victim, has committed aggravated penetrative sexual assault on the victim, on several occasions. Hence the case.

3. There is no representation on behalf of the petitioner.

4. At this juncture, the learned Government Advocate (Criminal side) has submitted the statement of the victim girl recorded under Section 183 of B.N.S.S. on 04.02.2026 and strongly objected for the bail application.

5. According to the said statement, the petitioner has committed aggravated penetrative sexual assault against the victim girl and the petitioner is none other than the paternal uncle of the victim, aged about 41 years. Considering the said severity of allegations, this Court is not inclined to enlarge the petitioner on bail.

6. Accordingly, this Criminal Original Petition is dismissed. 12-06-2026 MJS
