Instant Application in A.No.3274 of 2023 has been filed by the applicant/plaintiff in the suit, seeking leave of the Court to produce the additional documents namely sample sales invoices of the applicant/plaintiff from the year 1986 to 2002.

2. The applicant herein filed a suit for permanent injunction restraining the respondent from infringing the plaintiff's registered trademark "CYCLE with the device of a Cycle" and also restraining the respondent from passing off its products as that of the applicant.

3. In the affidavit filed in support of this application, it is asserted by the applicant that he filed the sample sales invoices in support of suit claim as Document No.4 along with the plaint. However, due to lapse of time, he is unable to trace the originals of the sample invoices, which were filed along with the plaint. Therefore, now he wants to produce the other original invoices as additional documents.
