ORDER
The petitioner apprehends arrest for the alleged offence under Sections 8(c) r/w 20(b)(ii)(C), 25 & 29(1) of NDPS Act in Crime No.214 of 2025 on the file of the respondent police seeks anticipatory bail.
2. The case of the prosecution is that the petitioner along with other accused persons were found in possession of 22 kgs of Ganja. Hence the case.
3. The learned counsel appearing for the petitioner submitted that there is no recovery made from the petitioner and that he is not at all present in the scene of occurrence. Only based upon the confession statement of the coaccused, the petitioner has been falsely implicated in this present case. Hence, he prays to grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the petitioner along with other accused persons were found in possession of 22 kgs of Ganja. Hence, he opposed to grant anticipatory bail to the petitioner.
5. I have given anxious consideration to the submissions made by the learned counsel on either side.
6. From the submission of the learned counsel on either side, this Court is of the view that the quantity involved is a commercial quantity attracting the rigour under Section 37 of the Narcotic Drugs and Psychotropic Substances Act, 1985. Hence, this Court is not inclined to enlarge the petitioner on bail.
7. Accordingly, this Criminal Original Petition stands dismissed. 10-06-2026 NSL
