Respondents PRAYER:- Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure, to direct the third respondent police not to harass the petitioner on the basis of the false complaints lodged by his rival persons namely Aarthi, Ramesh and Chellayan and their associates in connection with the Civil dispute regarding management of the Sri Mariyamman Temple, Kilkovalaivedu Village, Vandavasi Taluk, Thiruvannamalai District.

O R D E R

This Criminal Original Petition is filed to direct the third respondent police not to harass the petitioner on the basis of the false complaints lodged by his rival persons namely Aarthi, Ramesh and Chellayan and their associates in connection with the Civil dispute regarding management of Sri Mariyamman Temple, Kilkovalaivedu Village, Vandavasi Taluk, Thiruvannamalai District.

2. The learned counsel appearing for the petitioner submitted that the petitioner was called for enquiry on the complaint given by one Ramesh. The petitioner also lodged a complaint against the said Ramesh and the third respondent police assigned C.S.R.Nos.256 and 257 of 2021 and the same are pending. The third respondent police in the guise of enquiry had been calling the petitioner at the hard hours. Further he submitted that the above cases are civil in nature.

3. The learned Additional Public Prosecutor submits that the petitioner had given a complaint and the said Ramesh had given a counter complaint and two C.S.R.Nos.256 & 257 of 2021 have been assigned on the same day. Since, there is a disturbance of public peace, the Inspector of Police, North Police Station, Vandavasi referred the above said complaints to the Revenue Divisional Officer, Cheyyar, Thiruvannamalai District, to initiate proceedings under Section 107 Cr.P.C.

4. Recording the submissions of the learned Additional Public Prosecutor, this Criminal Original Petition stands disposed of.
