The petitioners have filed this writ petition seeking issuance of Writ of Mandamus directing the respondents to carry out the corrections regarding correct extent of petitioners land situated in R.S.No.100/3A, Punjai Lakkapuram Village, Modakurichi Taluk, Erode District.
2.The case of the petitioners is that the petitioners 2 and 3 are the daughters of the first petitioner. The first petitioner is the owner of the subject property. The first respondent acquired 0.37.0 hectare of the subject property for public purpose and award was passed on 13.01.2015. Thereafter, the petitioners partitioned the remaining portion of the subject property among themselves and they intended to lay boundary stone in their respective share and approached the second respondent. At that time, they came to know that it was wrongly mentioned in the revenue records that the first respondent had acquired an extent of 0.42.41 hectare. Hence, they made representation dated 11.02.2019 to the respondents seeking corrections in the revenue records and since there was no response, have filed this writ petition.
3.The learned counsel appearing for the petitioners submitted that without going into the merits of the case, it would suffice, if this Court issues direction to the respondents to consider the petitioners representation dated 11.02.2019 and to pass appropriate orders within a reasonable time frame. 4.Considering the limited request made by the learned counsel appearing for the petitioners, this Court, without expressing any opinion on the merits of the case, directs the respondents to consider the petitioners representation dated 11.02.2019, on merits and in accordance with law and to pass appropriate orders, within a period of twelve weeks from the date of receipt of a copy of this order.
