Prayer in both appeals: The Civil Miscellaneous appeals are filed
under Section 173 of the Motor Vehicles Act, 1988 as against the judgment and decree made in MCOP No.57 of 2017, dated 14.08.2019 on the file of the Special District Judge, Motor Accident Claims Tribunal, Tiruvallur.
CMA No.1887 of 2021 For Appellant : Mr.E.Rajadurai For Respondents : Mr.AGF Terry Chella Raja for first respondent CMA No.2579 of 2021 For Appellant : Mr. AGF Terry Chella Raja For Respondents : Mr.E.Rajadurai, for second respondent COMMON JUDGMENT When the civil miscellaneous appeals are taken up for hearing, the learned counsel for the appellant in CMA No.1887 of 2021 and the second respondent in CMA No.2579 of 2021, and the learned counsel for the first respondent in CMA No.1887 f 2021 and appellant in CMA No.2579 of 2021 have filed a joint compromise memo stating that the claimant agreed to receive a sum of Rs.24,65,000/- in full quit, in lieu of the award dated 14.08.2018 passed by the Special District Court, Motor Accidents Claims Tribunal, Tiruvallur in MCOP No.57 of 2017
2. The joint compromise memo is signed by the claimant and the contesting insurance company. The owner of the vehicle remained exparte before the Tribunal and hence, notice to him was dispensed with by this court. Therefore, the owner of the vehicle has not signed the joint compromise memo.
3. The joint compromise memo signed by the contesting parties, dated 06.02.2025 is recorded.
4. The civil miscellaneous appeal No.1887 and 2579 of 2021 are disposed of in terms of the Joint Compromise memo dated 06.02.2025. The said Joint Compromise Memo shall form part and parcel of the decree passed in these appeals. There shall be no order as to costs.
