ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c), 20(b)(ii) (C), 25 29(1) of NDPS Act, in Crime No.75 of 2026, on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that on 18.03.2026 at about 8.15.A.M., when the respondent police were on routine surveillance near Palakkad Main Road-Puttuvikki Road Junction, Kuniyamuthur, they found the petitioner in possession of 46 bundles wrapped with khaki coloured tape along with loose Ganja. Hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He would further submit that the petitioner is ready and willing to abide by any condition that may be imposed by this Court and hence, prayed to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal side) strongly objected to grant anticipatory bail to the petitioner on the ground that there are four NDPS Act cases pending against the petitioner, among which, two cases have

been registered for Commercial quantity. He would further submit that if the petitioner is granted anticipatory bail, he may abscond and commit similar offences in future as well.

5. From the submissions made by the learned Government Advocate (Crl.Side), it appears that the petitioner is having four NDPS cases to his credit. Further, it is amply clear from the submissions made by the learned Government Advocate (Crl.Side) that if any anticipatory bail is granted, it would become an adverse impact upon the Society. Considering the interest of Society at large, this Court is not inclined to grant anticipatory bail to the petitioner.
