Prayer:- Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus by directing the respondents to release the petitioner on bail, on his personal bond without insisting sureties in respect of the case in Crime No.409/2009 on the file of 3rd respondent.

O R D E R

1.When the matter came up today for hearing, the learned counsel appearing for the petitioner is present and submitted that the issue involved in this writ petition has become infructuous and he seeks permission to withdraw the writ petition and has also made an endorsement in the petition to that effect.

2.The prayer in the writ petition is for a direction to the respondent to release the petitioner on bail on his personal bond in connection with the Cr.No.409/2009 on the file of the 3rd respondent. Pending the writ petition, the petitioner was released on his personal bond. Hence nothing survives for adjudication in the present writ petition.

3.Accordingly, this writ petition is dismissed as infructous. No costs.
