S.Prabakaran v. State Of Tamilnadu
W.M.P.No.18216 of 2022 in W.P.No.34108 of 2014 G.K.ILANTHIRAIYAN, J.
This petition has been filed to condone the delay of 140 days in filing the restoration petition to restore the writ petition on file.
2. It is seen that the restoration petition can be filed only for dismissed for default. On perusal of the order dated 22.01.2021 passed by this Court in W.P.No.34108 of 2014, this Court dismissed the writ petition as infructuous for the reason that the petitioner's name was included in the panel for promotion to the post in question and hence, nothing survives for adjudication.
3. Therefore, the restoration of the writ petition does not arise. Accordingly, this petition stands dismissed. However, the petitioner is at liberty to file a petition for clarification or review in the manner known to law, if so advised.
