Since the third respondent remained exparte before the Tribunal, notice to the third respondent is dispensed with. The remaining respondents have been duly served.

2. The petition is filed to condone the delay of 128 days in filing the appeal.

3. The learned counsel for the respondents have not raised any serious objection in allowing the petition.

4. Having satisfied with the reasons stated in the affidavit, filed in support of the petition, the delay is condoned and the petition is ordered.

5. Registry is directed to number the appeal, if it is otherwise in order and list the same for admission on 22.10.2021.
