ORDER
The present Criminal Revision Case is filed to set aside the order passed by the learned Principal District Munsif Cum Judicial Magistrate, Gudalur in Crl.M.P.No.50 of 2026 in C.C.No.48 of 2021 dated 24.04.2026. Through the impugned order, the trial Court rejected the application filed by the petitioner under Section 503 of the BNSS, 2023. The petitioner had sought the refund of a cash deposit of Rs.1,50,000/- made during the trial since he has been acquitted. However, the trial Court has held that the deposit was made pursuant to the orders of this Court and thus his request for refund cannot be entertained. __________ https://www.mhc.tn.gov.in/judis

2.In view of the fact that the petitioner has been acquitted, it is open to the petitioner to file a fresh application under Section 503 of the BNSS seeking the return of the cash deposit of Rs.1,50,000/-. If such an application is filed, the same would be considered and appropriate orders would be passed in accordance with law. It is also made clear that merely because the deposit was made pursuant to the orders of this Court cannot by itself, be a ground for the lower Court to deny or reject the petitioner's application, if it is otherwise permissible in accordance with law.
3.With the above observations, this Petition is disposed of. 27-05-2026 ep Note:
