Prayer: Writ Petition is filed under Article 226 to issue a Writ of Mandamus directing the respondents 1 to 3 to consider the petitioner's representation dated 06.08.2021 seeking no objection letter for transferring the property from Tamil Nadu Housing Board within a reasonable time to be fixed by this Court.

The above writ petition is filed seeking a direction to respondents to consider the petitioner's representation dated 06.08.2021 seeking a "No Objection Letter" for transfer of the property from the Tamil Nadu Housing Board within a reasonable time to be fixed by this Court.

2. It is the case of the petitioner that his father purchased the subject plot under various sale deeds dated 07.02.2005 and has been in possession and enjoyment of the same ever since. The petitioner's family started a Trust named "Karunya Illam" in the year 1995 and from the year 2001 onwards, has been running a vocational training centre for mentally challenged adult men. The NGO is functioning as a residential institution providing food, shelter, proper medical support, sports and other facilities. The Trust is also receiving monetary benefits and food subsidies from the State Government. Since the petitioner's father, being a senior citizen, is not in a position to maintain the property, he wanted to transfer the said property in favour of the petitioner.
When the petitioner approached the office of the Registrar Office, he was informed by the Officials that a "No Objection Certificate" from the Salem Housing Board was required in respect of the property. Therefore, he gave a representation in person to the Salem Housing Board on 06.08.2021 seeking a "No Objection Certificate". On 12.08.
Salem District calling for details relating to the petitioner's representation. Thereafter, no further communication was received from the department. Though the petitioner has given several representations on various dates, the same did not evoke any response. Hence, the petitioner has approached this Court.
3. Heard the learned counsels on either side and perused the materials available on record.
4. Considering the facts and circumstances of the case, a mandamus is issued to the respondents to consider the petitioner's representation dated 06.08.2021 and pass a speaking order on merits and in accordance with law, within a period of one month from the date of receipt of copy of this order.
5. With the above directions, this Writ Petition is allowed. No costs.
