ORDER
Petition is filed by the accused under Section 483 of the B.N.S.S. 2023 seeking bail for the offence under Section 399 I.P.C in connection with Cr.No.815 of 2010 on the file of respondent police, pending trial on the file of IV Additional District and Sessions Judge, Chennai in S.C.No.113 of 2020.
2. The learned counsel appearing for petitioner submitted that due to unavoidable circumstances, the accused failed to appear before this Court, hence Non-Bailable Warrant (NBW) was issued and on 03.07.2024, the NBW was not received by the Inspector of Police, NBW ready from 04.07.2024 letter
was forwarded by the IV Additional Sessions Judge, to the Assistant Commissioner, Deputy Commissioner of Police and thereafter on 20.01.2026 the warrant was executed and the petitioner was produced before this Court and remanded to judicial custody. Now, the accused is in continuous custody since his date of arrest, and the trial in the case has not yet commenced and this petitioner undertakes to appear before this Court regularly, to cooperate in the Trial, not tamper with witnesses and to abide by any condition. Hence, this petitioner/accused prayed to enlarge the petitioner on bail.

The learned Additional Public Prosecutor has filed his objection stating that NBW was issued against the petitioner/accused on 03.07.2024 and the same was executed on 20.01.2026 and he was remanded to judicial custody on the same date. This accused is having 11 previous cases and the same is pending. If the bail is granted there is a possibility of absconding by the accused and the trial proceedings will be affected. Further, he may likely to commit further similar offence and he may likely to tamper the witnesses and seriously objecting to grant bail to the accused.
4. Heard both sides and perused the materials placed on record.
5. Considering the rival submissions on either side, nature of offence, though there are several cases pending as against the petitioner, in all cases,
already bail was granted to him, all the cases are not similar in nature and considering the fact that the investigation is competed and the case is posted for trial and also the incarceration period spent by the petitioner from 20.01.2026, I am inclined to grant bail to the petitioner, subject to the following conditions: [a] Accordingly, the petitioner is ordered to be released on bail on condition to execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned IV Additional Sessions Judge, City Civil Court, Chennai and on further conditions that:
[b] the petitioner shall report before the Trial Court daily at 10.00 a.m., until further orders.
[c] the petitioner shall not commit any offence similar to the offence of which he is accused, or suspected, or of the commission of which he is suspected;
[d] the petitioner shall not abscond either during investigation or trial; [e] the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence;
[f] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the
petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
[g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
