Respondents PRAYER: Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Habeas Corpus to direct the first respondent to produce the body or person of the detenue namely S.Kiruthika daughter of Seetha aged about 16 years old before this Court and hand over the custody to the petitioner.

ORDER

(Order of the Court was made by M.M.SUNDRESH, J.) This habeas corpus petition has been filed by the petitioner, who is the mother of the detenue, to direct the first respondent to produce the body or person of the detenue namely S.Kiruthika aged about 16 years old, before this Court and hand over the custody to the petitioner.

2. There was no representation on the earlier occasion and even today.

3.We have perused the Status Report. It appears that the detenue has been secured and kept under the custody of the Child Welfare Committee, Dharmapuri. Now, at present, she is in the Government Home.

4. In such view of the matter, the above habeas corpus petition stands closed. However, we direct the Child Welfare Committee, Dharmapuri, to do the needful to the detenue for the continuation of her studies and take measures for her betterment as it is informed neither the petitioner nor her husband is willing to take the detenue back.
