PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of Writ of Mandamus directing the respondent to cancel the UDR Patta, based on representation dated 0403.2015 filed by the petitioner.

Heard Mr.M.Ravi, learned counsel appearing for the petitioner and Mr.M.L.Mahendran, learned Government Advocate for the respondents. With the consent of both sides, the writ petition itself is taken up for final disposal.

2. The petitioner seeks for a direction upon the respondent to cancel the UDR Patta, based on his representation dated 04.03.2015.

3. According to the petitioner, the land in question was purchased by her grandfather and after the demise of her grandfather, her father inherited the property and they were in possession and enjoyment of the same. One Gavurappan was cultivating the land and the UDR patta was given in his favour. The petitioner would state that she is entitled to get the patta and UDR patta was wrongly given https://hcservices.ecourts.gov.in/hcservices/

in favour of the said Gavurappan. In this regard she has submitted a representation to the District Collector on 22.12.2014 and another representation to the respondent on 04.03.2015. Since there is no response, she is before this Court with this petition.

5. The said Gavurappan was not impleaded as respondent in this writ petition and hence, the merits of the claim made by the petitioner cannot be gone into in this writ petition. In the light of the above, without going into the merits of the claim of the petitioner, there will be a direction to the respondent to consider the petitioner's representation dated 04.03.2015 and pass appropriate orders, after giving an opportunity of personal hearing to the petitioner as well as the Gavurappan, on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.
