This Criminal Original Petition has been filed by the petitioners/ A2 & A3, who were arrested and remanded to judicial custody on 29.05.2024, seeking bail in Crime No.139 of 2024 registered for the offence under Sections 294(b), 323, 302 and 506(ii) of IPC.

2. Learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. He further submitted that when A1/son of the petitioners herein, was working in the field, the de facto complainant and her husband had voluntarily picked up the quarrel with him, during which, the victim/deceased fell down due to the cardiac arrest and died. He also submitted that the petitioners, who are aged about 61 and 54 years respectively, are no way connected with the alleged offence and are suffering incarceration from 29.05.2024. Hence, he prayed to grant bail to the petitioners.

3. Learned Government Advocate (Criminal Side) appearing for the respondent police objected for granting bail stating that due to the existing civil dispute, the petitioners herein along with their son/A1, who are the neighboring land owners of the de facto complainant, assaulted and caused death to the de facto complainant's husband. 4. Taking into consideration the facts and circumstances of this case and the submissions made by the learned counsel on either side and taking note of the fact that the investigation is at initial stage, this Court is not inclined to grant bail to the petitioners.
