ORDER

The petitioner, who was arrested and remanded to judicial custody on 07.11.2024 for the alleged offences under Sections 8 (c) r/w 20 (b) (ii) (C), 25 and 29 (1) of the NDPS Act, in Crime No.54 of 2024 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused was found in illegal possession of 42 kg of Ganja. Hence the case.

3.The learned counsel for the petitioner submitted that the petitioner is innocent and has been in custody since 07.11.2024. He further submitted that he is ready to abide by any stringent condition that may be imposed by this Court and ready to co-operate for investigation. Hence, he prays to grant bail to the petitioner.

4.The learned Government Advocate (Criminal Side) appearing for the respondent police drew the attention of this Court to the orders dated 30.01.2026 and 10.04.2026, wherein this Court dismissed the petition in Crl.O.P.No.9100 of 2026 on the ground of petitioner's past conduct, specifically having a pending case in Cr.No.863 of 2022 for possession of 94 kg of Ganja. He further submitted that there is no change in circumstances. Hence, he opposed for the grant of bail to the petitioner. 5.Considering the fact that this case involves the recovery of 42 kg of Ganja and considering that there is no change in circumstances from the earlier applications, this Court is not inclined to grant bail to the petitioner. Hence, the Criminal Original Petition is dismissed.
