Petition filed under Article 226 of the Constitution of India for the issuance of writ of Certiorarified Mandamus, to call for the records of the dismissal order with No.008/AHSS/2008-2009 dated 05.05.2008 issued by the second respondent and to quash the same and consequently to direct the second respondent to reinstate the petitioner into service with all other consequential benefits including backwages.

O R D E R
The petitioner was dismissed from service by the second respondent. The said order was challenged before the first respondent. Even though appeal was filed as early as on 15.05.2008, the first respondent has not taken any action to dispose of the appeal on merits.
2. The documents available on record indicates that the first respondent issued notice to the second respondent as early as on 03.11.2009. It is therefore evident that nothing was moved after filing the appeal by the petitioner.
3. The learned Government Advocate (Puducherry) on instructions submitted that appeal would be disposed of within a period of three months.
4. The appeal in question was filed as early as on 15.05.2008. The first respondent has issued notice to the second respondent way https://hcservices.ecourts.gov.in/hcservices/
back on 03.11.2009. The appeal being a statutory one, the first respondent was expected to dispose it of as expeditiously as possible.
5. The first respondent is directed to consider and dispose of the appeal filed by the petitioner on 15.05.2008 on merits and as per law. Such exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order. The petitioner is directed to cooperate with the first respondent for early disposal of the appeal.
