PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order of the first respondent in N.Dis.No.2554076/2026/D2 dated 11.03.2026 and quash the same and consequently direct the first respondent to number the unnumbered revision petition in Revision Petition S.R.No.2554076 of 2026 filed by the petitioner dated 06.03.2026 by condoning the delay of 674 days in filing the revision petition and dispose of the same on merits within a time frame that may be fixed by this Court.

ORDER
Seeking to call for the records pertaining to the impugned order of the first respondent in N.Dis.No.2554076/20226/D2 dated 11.03.2026 and to quash the same and consequently, to direct the first respondent to number the unnumbered revision petition in SR.No.2554076 of 2026 filed by the petitioner on 06.03.2026, by condoning the delay of 674 days in filing the revision petition, this writ petition is filed.
2. The learned counsel appearing for the petitioner submitted that there is no provision under the HR&CE Act conferring such power to the
Commissioner, HR&CE to condone the delay in entertaining the revision petition. He also drew my attention to the orders passed by this Court in W.P.No.11660 of 2021, wherein this Court by order dated 06.05.2021, has directed the respondents to entertain the revision petition by condoning the delay, and hence, sought indulgence in tune with the aforesaid order.
3. The learned Special Government Pleader appearing for the respondents submitted that he is aware of the order passed by this Court in W.P.No.11660 of 2021.
4. Heard either side and also perused the materials available on record.
5. In the light of the orders of the Court in W.P.No.11660 of 2021 and considering the fact that there is no express provision under the Act conferring power to condone the delay in entertaining the revision petition, this Court is of the considered view that the delay of 674 days in preferring a revision petition can very well be condoned.
6. Therefore, I am inclined to dispose of the writ petition. The first respondent is directed to entertain the revision petition filed by the petitioner and decide the same after affording an opportunity of hearing to the parties
concerned at the earliest, not later than twelve weeks from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition is closed.
