Heard Mr.S.Pushpakaran, learned counsel appearing for the petitioner and Mr.V.Jayaprakash Narayanan, learned Special Government Pleader appearing for the respondent. With the consent of both sides, the writ petition itself is taken up for final disposal.
2. The petitioner seeks for a direction upon the respondent to dispose of his application dated 11.07.2014 and correct the date of birth of his son V.Mohanraj from 13.02.1998 into 14.02.1998 in the birth certificate pertaining to him.
3. According to the petitioner, his son was born on 14.02.1998, but at the time of issuing birth certificate, it has been wrongly entered as 13.02.1998, since initially the hospital authorities recorded as 13.02.1998 and subsequently, it was corrected https://hcservices.ecourts.gov.in/hcservices/
as 14.02.1998 because the time of birth is 12.35 a.m., which will be 14.02.1998 and necessary correction has been made in the birth report. The Chief Civil Surgeon Medical Officer, Government Hospital, Tambaram at Chrompet, vide letter dated 01.07.2014 informed the respondent that the son of the petitioner was born on 14.02.1998 at 12.35 a.m. in the Government Hospital, Tambaram.
4. Based on the said communication, the petitioner now seeks for rectification of the date of birth of his son. The petitioner's representation has been acknowledge by the respondent Municipality.
5. In the light of the above, without going into the merits of the claim of the petitioner, there will be a direction to the respondent to consider his application dated 11.07.2014 and pass appropriate orders, after giving an opportunity of personal hearing to the petitioner, on merits and in accordance with law within a period of two weeks from the date of receipt of a copy of this order.
